Happy Holiday Market / Rules & Regulations

Location & Dates - The location of the Happy Holiday Market (the “Market”) will be Grive PATH Plaza, Jersey City, NJ 07302. Markets will be held outdoors in all weather from 3pm to 8pm on November 20 and 24; and December 1, 4, 8, 11, 15, 18, and 22 of 2014.

Space & Equipment – Each Vendor will receive an approximately 10’ x 5’ space. Vendor sites will be assigned at the Organizer’s discretion the day of each Market. All Vendor materials, including goods, signage and personal items, must stay within the allocated space.

Tents – Tents are provided.

Tables – Table and chair rentals are not available for the Holiday Market.  Vendors must bring their own tables and/or chairs as needed.

Electricity/Lights – Electric lighting for the tents will be provided.  Any additional access to the electric service must be requested by the vendor and approved by 6th Borough Productions in advance.  Any unauthorized use of the electric service will be subject to immediate disconnection by Market staff to prevent potential market power outages.

Any time an outlet is utilized, make sure that you do not break the plastic covers on them.  If there is a plastic cover, please remove it with a screw driver.  If you do not have one, please let market staff know and they will remove it for you.  Any plastic covers that are broken off will be billed to the vendor in front of that outlet.  No exceptions.

Display & Presentation – Vendor displays are expected to be thoughtful and attractively-merchandised in keeping with the upscale nature of the Market. Vendors are responsible for providing all of their own display items, including a table cloth that completely skirts the table. Vendor’s re-stocking and personal items may be placed under the table, as long as the table cloth completely conceals them.

Merchandise Pricing – Prices should be visible for all products for sale. Vendors may not display or sell items that have not been previously approved for sale at the Market by 6th Borough Productions.

Branding – Vendors should brand their spaces with their business name / identity. Signs may be affixed to Vendor’s tent or table. 

Setup & Breakdown – Vendor setup will begin at 2 pm on the day of the Market. The Market will open to the public at 3 pm. All sales conclude at 8 pm. Vendors may not break down until after the close of the Market at 8 pm and all items must be completely moved out by 9 pm. 

Vendors are expected to be on time.  Late arrivals may not be allowed to set up after the Market has already begun so it is strongly advised that you contact Market management ASAP in the event of an unexpected delay.

NO DRIVING ON THE BLUE STONE.  If you are unable to pull your vehicle into your space in the market, you must unload at the curb and park your vehicle in the garage at Grove Pointe.  Again, there are no exceptions to this rule and any blue stone that is broken during our market will be billed to the vendor that broke it.

Site Appearance & Cleanup – Vendor areas must be kept neat and clean at all times. Vendors are responsible for cleaning their own area completely at the end of the Market and removing all trash, boxes, packing materials, and unsold goods. Garbage cans and dumpsters at the event are for patron and adjacent business use only and Vendors should bring their own garbage bag(s) and broom. Any garbage left at the end of the Market will incur a cleaning fee.

Vendor Vehicle Parking – Vendors will be able to park one vehicle in the Grove Pointe lot at the site of the market at no additional cost.

Vendor Cancellations / No-Shows – Refunds and credits are not given for Vendor cancellations. If a Vendor must cancel after paying the Vendor fee, he/she is requested to email 6th Borough Market (6thboroughmarket@gmail.com) as soon as possible. No-shows forfeit their right to participate in future Markets. Vendors cannot “sell” their space to another Vendor if they are unable to participate.        

Cancellations by the Organizer – The Organizer reserves the right to cancel a Market for any reason. In the event of cancellation by the Organizer, the Organizer’s liability to the Vendor shall be limited to the amount of any fees paid to the Organizer by the Vendor.

If the Market is cancelled in its entirety by the Organizer due to severe weather, a credit may be given for a future market date. Refunds will not be given. Severe weather includes persistent heavy rain, dangerously heavy wind, lightning, or any other weather condition that would jeopardize safety.

Sales Tax & Permits – Vendors are responsible for all licenses and taxes related to their sales.

Risk of Loss, Insurance and Indemnification – The Vendor assumes sole risk of loss, theft or damage to merchandise and other personal property belonging to the Vendor while such property or merchandise is on the Market premises. The Vendor acknowledges that the Organizer does not assume any responsibility to insure the safety of or to protect the Vendor’s merchandise from loss or damage caused by fire, rain, theft, malicious mischief, accident or any other cause. Vendor acknowledges that the Vendor has been advised to purchase insurance to protect against these and other losses. The Vendor agrees to indemnify and hold the Organizer harmless from any liability damage, cost or expense (including reasonable attorneys’ fees and court costs) arising from (a) Vendor’s use of or activities in or around Vendor’s spaces(s) or the Market premises and/or (b) injury to persons or property resulting from any cause whatsoever including, but not limited to, any furniture or fixtures in the Vendor’s space, or from merchandise, other property or other items, or food or beverage, sold or exchanged by the Vendor. The Vendor assumes full responsibility for all merchandise the Vendor offers for sale.  All vendors must have, and show proof of valid, active liability insurance.  Each vendor's liability insurance certificate must name all of the following in order to be allowed to vend at the Holiday Market:

Agreement – By purchasing this space, I acknowledge that I have read and will abide by the above rules and regulations. I also understand that my space is not guaranteed until I have made full payment.
